Here are the cliff notes: written in plain English, not legal language. Please read so we can all move forward on the same page.

Copyright:

We own our stuff - the videos, handouts, resources, website, name, logo. Anything tangible that is an expression of our intellectual property. All ours to give away, sell, reproduce, or give others permission to use. When you purchase a license to the Next Steps Path to Proficiency or any of our other online classes we are giving you permission to view the videos and download and keep the handouts for your personal use. You do not have permission to take our stuff, put your own name on it and repurpose it. You do not have permission to download the videos and keep them. You do not have permission to post our stuff on another site, like teachers pay teachers. You do not have permission to use our classes with large groups. Those are examples of copyright infringement and that is illegal. 

OCDE Project GLAD® National Training Center owns the copyright and trademark for the Project GLAD® model. Jody and Sara at Next Steps are licensed consultants for OCDE Project GLAD® NTC, but we do not hold the copyright to the learning guide, which means we can use their materials in our training but cannot sell, reproduce, or give away anything from the learning guide. 

Guidelines for use for trainers and instructional coaches:

Copyright is in full effect and sharing permissions, by law, must be obtained before using our content in your role as a GLAD® trainer or instructional coach. Next Steps is not a public entity. It is a shared project owned by the private companies, Strategic Steps and ESL Consulting Services. Sharing or distributing digital content is a copyright violation and is strictly prohibited.

 When enrolling for the Path to Proficiency membership site (P2P), both the individual plan and site plan entitles each member to a single-user license. This license allows you access to the content within the P2P membership site for your personal use.

 In your role as a GLAD® trainer and/or instructional coach, you may use the content by showing the videos ONLY IF the individual or school site you are working with is also a member of P2P. If the individual(s) you are working with have an active login and can access the site themselves, then you may come alongside them and use the videos and resources in your coaching.

If the individual(s) you are coaching do not have an individual plan nor are part of a site plan, and therefore cannot access the P2P site themselves, you are strictly prohibited from using Next Steps P2P content in your role as a trainer/coach. You may not repost or show any video clips or use our content at trainings, coaching sessions, meetings, conferences, or any situation involving individuals who are not members of P2P.

License: 

Individual Membership

You are purchasing a single-user license for the subscription site and individual priced classes. Each time you login on one of your devices it leaves a “signature” of which IP addresses are associated with your account. If we detect there are too many IP addresses logging in, we will assume you have shared your username and password with non-paying users, and we will contact you to resolve the issue. One of the actions we may take is freezing your account until the end of its term. Frozen accounts are not entitled to refunds.

What this means for you is that you can’t share your username and password with non-paying users. If you are an annual subscriber and your account gets frozen, you will not have access to the site until the start of the next annual billing cycle. If you are a monthly subscriber, your access will be frozen for a period of time at our discretion. 

Site Membership

School sites bulk purchase a fixed number of subscriptions for the list of staff members they send to us. Each staff person is assigned a code that they use when initially creating their username and password. Once those login credentials are created, IP address authentication happens the same way described above. If too many IP addresses are detected for any of the staff logins, the site administrator will be contacted to help resolve the issue. Freezing the login credentials for individuals is possible even at the site membership level.

Refunds

You are entitled to a refund for any reason within 30 days of purchase of a Next Steps product. If you pay monthly and your credit card is declined we will contact you by email to resolve the issue. If we cannot contact you within 30 days, your login will be frozen until you contact us to resolve the situation.

  4. While the Company uses reasonable efforts to include accurate and up-to-date information in the Site, the Company makes no warranties or representations as to its accuracy. The Company assumes no liability or responsibility for any errors or omissions in the content of the Site.
  5. When you register with the Company and/or this Site, you expressly consent to receive any notices, announcements, agreements, disclosures, reports, documents, communications concerning new products or services, or other records or correspondence from the Company. You consent to receive notices electronically by way of transmitting the notice to you by email.
  6. If you send comments or suggestions about the Site to the Company, including, but not limited to, notes, text, drawings, images, designs or computer programs, such submissions shall become, and shall remain, the sole property of the Company. No submission shall be subject to any obligation of confidence on the part of the Company.   7. The Company shall use commercially reasonable efforts to restrict unauthorized access to our data and files. However no system whether or not password protected can be entirely impenetrable. You acknowledge that it may be possible for an unauthorized third party to access, view, copy, modify, or distribute the data and files you store using the Site. Use of the Site is completely at your own risk.

The Company will not intentionally disclose any personally identifying information about you to third parties, except where the Company, in good faith, believes such disclosure is necessary to comply with the law or enforce these Terms of Use. By using the Site, you signify your acceptance of the Company’s Privacy Policy. If you do not agree with this Privacy Policy, in whole or part, please do not use this Site.

  14. This agreement shall be governed by and construed in accordance with the laws of the State of Washington, without giving effect to any principles of conflicts of law. You further submit to the exclusive jurisdiction of the state and federal courts sitting in Washington State. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

When you access the Website, the Company will learn certain information about you during your visit. 

Information You Provide To Us. The Website provides various places for users to provide information. We collect information that users provide by filling out forms on the Website, communicating with us via contact forms, responding to surveys, search queries on our search feature, providing comments or other feedback, and providing information when ordering a product or service via the Website.  

We use information you provide to us to deliver the requested product and/or service, to improve our overall performance, and to provide you with offers, promotions, and information.

Email Information 

If you choose to correspond with us through email, we may retain the content of your email messages together with your email address and our responses. We provide the same protections for these electronic communications that we employ in the maintenance of information received online, mail, and telephone. We are committed to keeping your e-mail address confidential. We do not sell, rent, or lease our subscription lists to third parties, and will not disclose your email address to any third parties except as allowed in the section titled Disclosure of Your Information. 

We will maintain the information you send via e-mail in accordance with applicable federal law. 

In compliance with the CAN-SPAM Act, all e-mails sent from our organization will clearly state who the e-mail is from and provide clear information on how to contact the sender. In addition, all e-mail messages will also contain concise information on how to remove yourself from our mailing list so that you receive no further e-mail communication from us. 

Our emails provide users the opportunity to opt-out of receiving communications from us and our partners by reading the unsubscribe instructions located at the bottom of any e-mail they receive from us at anytime.

How And Why We Collect Information 

The Company collects your information in order to record and support your participation in the activities you select. We may disclose information when legally compelled to do so, in other words, when we, in good faith, believe that the law requires it or for the protection of our legal rights or when compelled by a court or other governmental entity to do so. 

How Do We Protect Your Information and Secure Information Transmissions? 

We employ commercially reasonable methods to ensure the security of the information you provide to us and the information we collect automatically. This includes using standard security protocols and working only with reputable third-party vendors. 

Email is not recognized as a secure medium of communication. For this reason, we request that you do not send private information to us by email. However, doing so is allowed, but at your own risk. Some of the information you may enter on our website may be transmitted securely via a secure medium known as Secure Sockets Layer, or SSL. Credit Card information and other sensitive information is never transmitted via email. 

The Company may use software programs to create summary statistics, which are used for such purposes as assessing the number of visitors to the different sections of our site, what information is of most and least interest, determining technical design specifications, and identifying system performance or problem areas.
